Terms & Conditions (T&Cs)

1. Scope of Application
By placing an order, the customer explicitly agrees to these T&Cs. Deviations from these T&Cs are only valid if confirmed in writing by Nyah-Nyah Games.

2. Prices
The prices listed in our online shop at the time of the order apply to all purchases. The stated prices are final prices in Swiss francs (CHF), including applicable VAT and other price components.
Price and assortment changes, as well as technical modifications, are reserved. All offers are non-binding. Errors and typographical mistakes are excepted.

3. Delivery
We deliver throughout Switzerland and worldwide via parcel service from Swiss Post. Shipping costs are based on the most cost-effective shipping option for the respective destination.

4. Payment Terms
We accept all major credit cards, as well as PayPal, Apple Pay, and Google Pay. Prepayment by bank transfer is also possible.

5. Refusal of Acceptance
If a customer unjustifiably refuses to accept delivered goods, Nyah-Nyah Games reserves the right to charge the customer for the costs incurred.

6. Returns/Exchanges
Nyah-Nyah Games offers a voluntary return policy for products within 14 days of dispatch or collection.

• Returns are only accepted if the product is undamaged, complete, and unopened (including plastic wrap, seals, etc.).

• Opened games are excluded from the return policy, as completeness and resellability cannot be guaranteed.

• Returns are at the expense and risk of the customer. The purchase price will be refunded upon receipt of the returned goods.

  
  

7. Statutory Warranty
The statutory warranty for product defects remains unaffected by the voluntary return policy.
Nyah-Nyah Games is liable under statutory provisions for product defects that existed at the time of delivery. Customers must report defects without delay to claim warranty rights.

8. Retention of Ownership
The delivered goods remain the property of Nyah-Nyah Games until full payment has been made.

9. Limitation of Liability
Nyah-Nyah Games excludes all liability for the delivered and sold products to the extent permitted by law. This specifically includes damage resulting from improper use or failure to follow the instructions provided in the game manual.

This game is intended for persons aged 14 and older. Parents or guardians are responsible for supervising the use of the game by younger children.

Liability for intent, gross negligence, and damage to life, body, or health is not excluded.

10. Severability Clause
Should any provision of these T&Cs be invalid, unenforceable, or incomplete, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced with a provision that most closely reflects the intended economic purpose of the invalid provision.

11. Place of Jurisdiction
These terms are governed by Swiss law. The exclusive place of jurisdiction for all disputes is Zurich.
