1. Validity of these terms and conditions

• By submitting an order or executing a download, the customer expressly agrees to these terms and conditions. Deviations from these terms and conditions are only effective if we confirm them in writing.

2. Prices

• For orders in our Internet store, the prices listed in the offer at the time of the order apply. The prices quoted are final prices in Swiss francs (CHF), i.e. they include the applicable statutory VAT and other price components.

• We reserve the right to make changes to prices and product ranges as well as technical changes. All offers are non-binding. Erroneous information and printing errors excepted.

3. Delivery

• We deliver throughout Switzerland and worldwide via Swiss Post parcel service. The shipping costs are based on the cheapest shipping option for the respective country zone.

4. Means of payment

• All major credit cards are accepted as payment methods, as well as Paypal, Apple Pay and Google Pay. Prepayment by bank transfer is also possible.

5. Refusal of acceptance

• In the event of unjustified refusal to accept the goods delivered by us, we shall be entitled to charge the costs incurred by us.

6. Warranty

• Nyah-Nyah Games guarantees that the ordered product is free of defects and functional for the period specified in the product description after delivery or collection. The warranty period shall continue irrespective of the provision of any warranty services. The warranty can be provided by Nyah-Nyah Games in the following ways:

  - Free repair (original warranty period continues to run on the products). There is no entitlement to a replacement product for the duration of the repair.
  - Replacement with an equivalent product by Nyah-Nyah Games (new warranty period of the duration specified in the product description from replacement)
  - Credit note (maximum of the sales price at the time of the order)
  - Price reduction
  

• In the event of repairs, the customer shall send the defective product to Nyah-Nyah Games at his own expense and risk.

• The warranty claim shall lapse if the defect is due to improper use, storage and handling of the products.

• All further and, in particular, statutory warranty provisions are excluded.

7. Return/exchange

• Nyah-Nyah Games grants a voluntary right of return on ordered products for a period of 14 days from dispatch or collection of the goods. A copy of the invoice must be enclosed to process the return.

• The right of return is subject to the condition that the goods are returned undamaged, complete and unopened (plastic film, seal, etc.).

• Digital products are excluded from exchange and cannot be returned.

• Damage during transportation must be reported to us within 48 hours. Otherwise the right to a free replacement expires.

• Returns due to dislike are excluded.

8. Retention of title

• The delivered goods remain the property of Nyah-Nyah Games until full payment has been received.

9. Limitation of liability

• Nyah-Nyah Games excludes any liability for the delivered and sold products to the extent permitted by law.

10. Place of jurisdiction

• The legal relationships are subject to Swiss law. The exclusive place of jurisdiction for all disputes is Zurich.
